Definitions

  • Radio Programs: Any audio content broadcast or streamed via the detour network.
  • Sound Recordings: Any musical or audio content protected under copyright law.
  • The Detour: The detour network, its staff, and management.

Content Restrictions

Broadcasts must not contain any content that:

  • Is obscene, fraudulent, indecent, discourteous, racially offensive, or abusive
  • Defames, abuses, harasses, or threatens others
  • Advocates the use of viruses, Trojan horses, worms, time bombs, cancelbots, or other harmful devices intended to damage, interfere with, or expropriate any computer system, data, or personal information
  • Encourages or advocates illegal activity
  • Violates the privacy of individuals, including other hosts or listeners
  • Violates any applicable local, state, national, or international law, including the DMCA

Compliance and Enforcement

The detour, in its sole discretion, will determine whether content complies with these rules. Non-compliant content may be removed without prior notice.

Possible consequences include:

  • Removal of your content or Radio Programs
  • Suspension of broadcasting privileges
  • Notification to legal authorities if applicable

DMCA Compliance Requirements

To comply with the DMCA and other copyright laws, you agree to follow these rules:

  1. Do not include specific sound recordings in your programs within one hour of a listener request.
  2. In any three-hour period, avoid programming more than:
    • Three songs (and not more than two in a row) from the same recording
    • Four songs (and not more than three in a row) from the same artist or anthology/box set
  3. Continuous looped Radio Programs must be at least three hours long.
  4. Retransmissions of Radio Programs:
    • Programs under one hour: max three times in two weeks
    • Programs over one hour: max four times in two weeks
  5. Do not pre-announce specific recordings or the order they will be played.
  6. Only include sound recordings authorized for performance in the United States.
  7. Pass through all identification or technological protection information included in the recordings.

Additional Notes

  • If you are unsure whether content is authorized or compliant, do not include it.
  • These rules apply to all Radio Programs and other content you post on the detour’s website.
  • The detour reserves the right to update these rules at any time.
